The Allahabad High Court is once again in the spotlight due to a controversial judgment. On April 10, while hearing a bail plea in a rape case, the court granted bail to the accused and made remarks that have sparked a nationwide debate.
The case involves an M.A. student from Uttar Pradesh, who filed a rape complaint against a male acquaintance in September 2024. According to her complaint, she and three female friends had gone to a bar in Delhi where they met some known men, including the accused.
What Happened?
As per the FIR, the woman stated that she was intoxicated and the accused persistently asked her to accompany him. Eventually, she agreed to go with him to rest. However, instead of taking her to his home, the accused took her to a relative’s flat in Noida, where he allegedly raped her.
She filed a police complaint, and the accused was arrested in December 2024.
The Accused’s Statement:
In his bail application, the accused claimed that the woman willingly accompanied him and the sexual act was consensual. He denied the rape allegations.
What Did the Court Say?
While granting bail, Justice Sanjay Kumar of the Allahabad High Court stated:
“Even if the allegations made by the victim are accepted as true, it appears that she herself invited the trouble, and therefore is equally responsible for what happened.”
He further noted that the woman is a postgraduate student and capable of understanding the moral and legal implications of her actions.
The court also mentioned that the medical report did not confirm any sexual assault. Taking into account the facts, circumstances, and evidence, the judge allowed the bail plea.
