Shimla, March 15 — The Himachal Pradesh High Court has ruled that the family of a government employee who voluntarily resigned from service cannot claim family pension benefits under existing service rules. The court dismissed a petition filed by the family seeking pension after the employee’s death.
The case was heard by a division bench of the Himachal Pradesh High Court, which examined whether the family of a former employee who had resigned from service was entitled to pensionary benefits normally granted to the families of government employees.
Court rejects pension claim
The petitioner had approached the court after authorities rejected the request for family pension. The family argued that pension should be granted despite the employee having left government service earlier.
However, the High Court observed that under government service rules, family pension is available only when an employee retires or dies while still in service. Since the employee had resigned voluntarily, the service benefits associated with retirement did not apply.
The court noted that resignation leads to termination of service and breaks the link between the employee and pension entitlements unless specific provisions allow otherwise.
