1. Introduction and Acceptance

These Terms of Service (“Terms”) govern your use of the websites operated by Enoxx News Private Limited (hereinafter referred to as “the Company”, “we”, “us”, or “our”), including but not limited to enoxxnews.com and enoxxnews.in, as well as our internal mobile and web applications, including the Enoxx Ground field-reporting application used by our authorised editorial staff and field reporters.

By accessing or using any of our websites, services, or applications, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not access or use our services.

The Company is a news and media entity duly incorporated under the Companies Act, 2013, and operates in compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Digital Personal Data Protection (DPDP) Act, 2023, and other applicable Indian laws.

2. Eligibility

To use our services, you must:

Be at least 18 years of age, or have the consent of a parent or legal guardian if you are a minor permitted by applicable law to use such services;
Provide accurate and complete information when required;
Comply with all applicable laws and these Terms.

The Enoxx Ground application (described in Section 9) is restricted exclusively to authorised editorial staff and field reporters of the Company and is not available to the general public.

3. Nature of Service

Digital News Publisher. Enoxx News is a digital news publisher distributing regional and global news content via our websites and official social media intermediaries, including YouTube, Facebook, and Instagram. We are not a satellite television channel and are not available on any OTT platforms. The term “Channel” used in our branding refers strictly to our digital and social media distribution networks.
Geographic Focus. While our regional wings (Enoxx Himachal News, Enoxx News Punjab, Enoxx News Jammu & Kashmir) focus on Indian state-level news, our flagship websites cover Indian national news and global news topics relevant to our audience.
Editorial Independence. All editorial content is produced under the supervision of our Editor-in-Chief in accordance with applicable journalistic standards and the Code of Ethics for Digital News Publishers under the IT Rules, 2021.

4. User Accounts

Certain features (such as newsletter subscriptions or Citizen Journalism submissions) may require you to register an account. You are responsible for:

Maintaining the confidentiality of your account credentials;
All activities that occur under your account;
Notifying us immediately of any unauthorised use of your account.

We reserve the right to suspend or terminate any account that violates these Terms, applicable law, or the editorial standards of the Company.

5. Acceptable Use

You agree not to:

Use our services for any unlawful purpose or in violation of any applicable Indian or international law;
Post, upload, or transmit any content that is defamatory, obscene, hateful, threatening, infringing on intellectual property rights, or otherwise objectionable under Rule 3 of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021;
Attempt to gain unauthorised access to our systems, accounts, or data;
Use automated tools (bots, scrapers, crawlers) to access or extract content from our websites except as expressly permitted by our robots.txt and applicable law;
Impersonate any person or entity, or misrepresent your affiliation with the Company;
Interfere with the operation of our websites, applications, or services;
Use our content in a manner that violates the intellectual property terms in Section 7.

Violation of this section may result in termination of access and, where applicable, legal action.

6. User-Generated Content (Comments, Citizen Journalism, Submissions)

If you submit content to us — through comments, Citizen Journalism submissions, news tips, or any other interactive feature — you represent and warrant that:

You own or have all necessary rights to the content you submit;
The content does not infringe on the intellectual property, privacy, or other rights of any third party;
The content is accurate to the best of your knowledge.

By submitting content, you grant the Company a non-exclusive, royalty-free, worldwide, perpetual licence to use, edit, reproduce, modify, adapt, publish, and distribute that content across our websites, applications, and social media intermediaries, with appropriate attribution where reasonable.

The Company reserves the right to:

Edit submitted content for clarity, accuracy, length, or compliance with editorial standards;
Verify the authenticity of news tips and submissions before publication;
Decline to publish any submitted content at our sole editorial discretion;
Remove submitted content that is later found to violate these Terms or applicable law.

7. Intellectual Property

Our Content. All original content published on our websites and applications — including articles, photographs, videos, graphics, logos, and the “Enoxx News” name and branding — is the property of Enoxx News Private Limited or its licensors and is protected under the Copyright Act, 1957, and other applicable laws. You may not reproduce, redistribute, or commercially exploit our content without prior written permission, except as permitted by the Fair Dealing provisions of Section 52 of the Copyright Act, 1957.
Third-Party Content. In the interest of comprehensive news reporting, we may use photographs, images, or short video clips from third-party sources for informational, educational, and news reporting purposes, in reliance on the Fair Dealing exception. We do not claim ownership of such third-party material. If you are a copyright owner with concerns about specific usage, please contact our Grievance Officer (see Section 12).
Personal Use. You may view, share, and link to our content for personal, non-commercial purposes, with appropriate attribution to Enoxx News.

8. Third-Party Platforms

Our content is also distributed via third-party platforms including YouTube, Facebook, and Instagram. Your use of those platforms is governed by their respective terms of service and privacy policies, not by these Terms. The Company is not responsible for:

The availability, content, or behaviour of third-party platforms;
Comments, reactions, or shares posted on third-party platforms by other users;
Any technical issues, data breaches, or service interruptions occurring on those platforms.

9. Enoxx Ground Mobile and Web Application

This Section 9 applies in addition to the general terms above and governs use of the Enoxx Ground field-reporting platform. Enoxx Ground consists of a web dashboard at dashboard.enoxxnews.in and an Android mobile application, used together by the Company’s authorised editorial staff and field reporters to publish live news broadcasts and recorded video reports to the Company’s official Facebook Pages and Instagram Business accounts.

9.1 Authorised use only

Enoxx Ground is not a consumer-facing application. It is provided exclusively to:

Editorial staff of Enoxx News Private Limited employed in roles such as administrator, news producer, video editor, designer, or publisher;
Authorised field reporters and contributors employed or engaged by the Company to file live broadcasts and recorded reports.

The application is not listed on the Google Play Store or Apple App Store. Access is granted by the Company’s super-administrator and may be revoked at any time. Distribution of the Enoxx Ground APK or dashboard access credentials to any unauthorised person is strictly prohibited and may result in immediate termination of the recipient’s engagement with the Company and legal action.

9.2 Authorised users’ obligations

If you have been granted access to Enoxx Ground, you agree to:

Use the application only for purposes authorised by the Company — namely, the production and publication of news content on the Company’s official Pages and accounts;
Not publish content from your personal Facebook or Instagram accounts using credentials obtained through Enoxx Ground;
Not share your account credentials with any other person;
Not attempt to access or modify data, broadcasts, or accounts that you have not been authorised to manage;
Comply with the Company’s editorial guidelines and the Code of Ethics for Digital News Publishers under the IT Rules, 2021;
Promptly report any unauthorised access, suspected security incident, or technical issue to the Editor-in-Chief.

9.3 Content ownership and licensing for Enoxx Ground users

All live broadcasts, video reports, photographs, and other content produced by authorised users while using Enoxx Ground in the course of their engagement with the Company are considered work-for-hire and are the property of Enoxx News Private Limited. By using Enoxx Ground, you assign all rights, title, and interest in such content to the Company. The Company will provide appropriate attribution to reporters in published content where editorially appropriate.

9.4 Compliance with platform policies

When publishing through Enoxx Ground to Facebook Pages or Instagram accounts, you agree to comply with:

Meta’s Community Standards and Platform Policies;
Meta’s Live Video and Content Publishing policies;
The Company’s editorial guidelines, which incorporate these platform policies by reference.

The Company may suspend or revoke your access to Enoxx Ground if your use of the application violates Meta’s policies, Indian law, or the Company’s editorial standards.

9.5 Service availability and modifications

The Company may, at its sole discretion and without prior notice, modify, suspend, discontinue, or limit any feature of Enoxx Ground. We make no guarantee of uninterrupted availability and are not liable for any disruption arising from infrastructure issues, third-party platform outages (including Meta API outages), or scheduled maintenance.

10. Disclaimers

Our services are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, except as required under the Consumer Protection Act, 2019, or other non-waivable applicable law.
The Company does not warrant that our websites or applications will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
News content represents the views of its authors at the time of publication. We strive for accuracy and verification but do not guarantee that all content is free from errors or omissions. Corrections and clarifications, where appropriate, are issued in accordance with our editorial policy.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

The Company, its directors, officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services;
The Company is not liable for content posted by users or third parties on our websites, applications, or social media intermediaries, in accordance with the safe-harbour provisions of Section 79 of the Information Technology Act, 2000;
The Company is not liable for any loss arising from technical issues, data breaches, or service interruptions occurring on third-party platforms (YouTube, Facebook, Instagram);
The Company’s total aggregate liability arising out of or related to these Terms shall not exceed INR 1,000 (one thousand Indian Rupees) or the amount you have paid to the Company in the twelve months preceding the claim, whichever is greater.

Nothing in these Terms limits liability that cannot be limited under applicable law (including, where applicable, liability for fraud, gross negligence, or wilful misconduct).

12. Statutory Grievance Redressal

In accordance with Rule 11(2) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, any person aggrieved by the content, services, or conduct of Enoxx News may contact our designated Grievance Officer:

We will acknowledge complaints within 24 hours and resolve them within fifteen (15) days from the date of receipt, in accordance with the IT Rules, 2021.

13. Termination

We reserve the right to suspend or terminate your access to our services at any time, with or without notice, for conduct that we believe violates these Terms, applicable law, or our editorial standards, or that is otherwise harmful to other users, third parties, or the Company.

14. Indemnification

You agree to indemnify and hold harmless the Company, its directors, officers, employees, and contractors from any claim, demand, loss, or damage (including reasonable legal fees) arising out of or related to your breach of these Terms, your misuse of our services, or your violation of applicable law or the rights of any third party.

15. Changes to These Terms

We may revise these Terms from time to time. The “Last Updated” date at the top of this document indicates when the Terms were last revised. Material changes will be communicated through our websites or via email to registered users. Your continued use of our services after revisions become effective constitutes your acceptance of the revised Terms.

16. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or related to these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts located in Dharamsala, Himachal Pradesh, India.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms or guidelines published on our websites or within Enoxx Ground, constitute the entire agreement between you and the Company regarding your use of our services and supersede all prior or contemporaneous communications and proposals on the same subject matter.
